The nature, possibility, and implications of ethics expertise in general and of bioethics expertise in particular has been the focus of extensive debate for over thirty years. What is ethics expertise and what does it enable experts to do? Knowing what ethics expertise is can help answer another important question: What, if anything, makes a claim of expertise legitimate? In other words, how does someone earn the appellation “ethics expert?” There remains deep disagreement on whether ethics expertise is possible, and (...) if so, what constitutes such expertise and what it entails and legitimates. Discussion of bioethics expertise has become particularly important given the growing presence of bioethicists in the clinical setting as well as efforts to professionalize bioethics through codes of ethics and certification efforts. Unlike in the law or in engineering, where there may be a body of knowledge that professional organizations or others have articulated as important for education and training of experts, ethics expertise admits of no such body of knowledge or required experience. Nor is there an entity seen as having the authority to articulate the necessary scope of knowledge. Questions about whether there is such a body of knowledge for particular areas within bioethics have emerged and played a central role in professionalization efforts in recent years, especially in the area of clinical ethics. I argue that valid informed consent is ethically required for organ donation from individuals declared dead using neurological criteria. Current policies in the U.S. do not require this and, not surprisingly, current practices inhibit the possibility of informed consent. Relevant information is withheld, opportunities to ensure understanding and appreciation are extremely limited, and the ability to make and communicate a free and voluntary decision is hindered by incomplete disclosure and other practices. Decisions regarding clinical procedures or research participation typically require the informed consent of individuals. When individuals are unable to give consent, the informed permission of a legally authorized representative or surrogate is required. Although many proposed procedures are aimed primarily at benefiting the individual, some are not. I argue that, particularly when individuals are asked to assume risks primarily or exclusively for the benefit of others, family members ought to be engaged in the informed consent process. Within and among societies, there are competing understandings of the status of children, including debates over whether they can bear rights and, if so, which rights they bear and against whom, and their capacity to make decisions and be held responsible and accountable for actions. There also are different understandings of what constitutes a family; what authority parents have over and regarding their children; and what should happen to children who are without parents because of death, desertion, or imprisonment. These (...) and other related debates reflect deep differences in worldviews, in how one understands the legitimate role of the state, in how one comes to know the proper way to raise children, and so on. The United Nations Convention on the Rights of the Child purports to reflect international convergence on the rights of children, on how decisions concerning children should be made, and on how children ought to be treated by the state and by their parents. This paper examines whether the Convention's framework for decision making concerning children is an appropriate framework for pediatric bioethics. Questions about how to make health care decisions for children ultimately are questions of who is in authority to make and judge such decisions. Establishing who is in authority, determining whether there are any limits to that authority and, if so, defining those limits should be the focus of efforts to develop and implement a pediatric decision-making framework. Plans to attempt what has been called a head transplant, a body transplant, and a head-to-body transplant in human beings raise numerous ethical, social, and legal questions, including the circumstances, if any, under which it would be ethically permissible to attempt whole-body transplantation (WBT) in human beings, the possible effect of WBT on family relationships, and how families should shape WBT decisions. Our assessment of many of these questions depends partially on how we respond to sometimes centuries-old philosophical thought experiments (...) about personal identity. As with so much in bioethics, it is impossible to escape, or at least inadvisable to try to bypass, the relevant foundational philosophical concerns. (shrink)

The term ‘culture wars’ has been used to describe deep, apparently intractable, disagreements between groups for many years. In contemporary discourse, it refers to disputes regarding significant moral matters carried out in the public square and for which there appears to be no way to achieve consensus or compromise. One set of battle lines is drawn between those who hold traditional Christian commitments and those who do not. Christian bioethics is nested in a set of moral and metaphysical understandings that (...) collide with those of the dominant secular culture. The result is a gulf between a moral life and an approach to bioethics framed in the face of a transcendent God and a final judgment versus a moral life and an approach to bioethics framed as if the world were without ultimate meaning and as if death were the end of personal existence. These approaches are separated by a moral and metaphysical gulf that sustains incompatible life worlds and incompatible understandings of bioethics. Attempts to bridge the gulf with secular reason are ineffective because there is no shared conception of reason or standard of evidence. Efforts to use the state to enforce a particular set of metaphysical and moral commitments, whether secular or religious, lead to public disputes with a war-like character. (shrink)

In most, if not all, jurisdictions with active organ transplantation programs, there is a persistent desire to increase donation rates because the demand for transplantable organs exceeds the supply. China, in particular, faces an extraordinary gap between the number of organs donated by deceased donors and the number of people seeking one or more transplants. China might look to Western countries with higher donation rates to determine how best to introduce Western practices into the Chinese system. In attempting to increase (...) its organ donation rate, China must not only ensure that its organ donation system reflects different Chinese cultural values, but also that it avoids the ethical problems of the United States and of other Western systems. This article examines four such problems. They concern the family, obtaining permission for organ donation, the definition and diagnosis of “brain death,” and trust. Revisions to the Chinese system should involve a careful look to China and Chinese cultural resources rather than to Western models. (shrink)

Recent work calls for excluding clinical ethics consultants’ religious ethical commitments from formulating recommendations about particular cases and communicating those recommendations. I demonstrate that three arguments that call for excluding religious ethical commitments from this work logically imply that consultants may not use their secular ethical commitments in their work. The call to sever clinical ethics consultation from the ethical commitments of clinical ethics consultants has implications for the scope of work consultants may do and for the competencies required for (...) such work. Examining how new forms of currencies diffuse is important to uncover their impact on the organization of communities, and thus motivates our study of community currencies. Community currencies provide a medium of exchange by using alternative banknotes or electronic money, which circulates only within particular communities, allowing members to trade goods, increase social cohesion, and achieve collective goals. In this study, we examine how community currencies help facilitate social commons by serving as a setting for building community relationships and a (...) catalyst for other social activities beyond market relations. We analyze cases of community banks that provide microfinance and issue community currencies in Brazil. We find that microfinance entrepreneurs who involve a greater diversity of stakeholders from public, private, and nonprofit sectors in decision making even prior to startup, while also facilitating the formation of supportive social capital from diverse cross-sector stakeholders, increase opportunities for developing new community currencies. By exploring the implications of entrepreneurial actions that promote inclusive participation of diverse stakeholders for accomplishing collective goals, our findings are relevant for other activities that create a common pool of resources while also developing the vitality of the community, including initiatives that use cryptocurrencies and other emerging forms of currencies for building social commons. Issues of institutional identity and integrity in Roman Catholic health care institutions have been addressed at the level of individual institutions as well as by organizations of Catholic health care providers and at various levels in the Church hierarchy. The papers by Carol Taylor, C.S.F.N, Thomas Shannon, Kevin O’Rourke, O.P., Gerard Magill in this volume provide a significant contribution to concerns of Roman Catholic health care institutions as they face the challenges of providing health care in a secular, pluralistic, market-driven (...) economy. One way to understand institutional integrity is as a measure of the coherence between what an institution identifies as its commitments (its stated moral character), what an institution does (its manifest moral character) and an institution’s fundamental moral commitments (its deep moral character). The essays in this volume support this model of integrity. Although it is not their explicit focus, the four essays together provide a vision of institutional integrity for Catholic health care institutions. Each author focuses on one of the three central aspects of integrity: what one identifies as one’s commitments (Taylor), how one's actions reflect one’s values (Shannon and Magill), and what one is or what one values at a deep level (O’Rourke). I will offer a brief overview of the ways in which the integrity of Catholic health care institutions has been addressed. Then I will consider the four essays and show how each offers an analysis of one of the three critical elements of integrity. (shrink)

The International Criminal Court (ICC) is responsible for prosecuting individuals for heinous crimes that take place during civil and/or international armed conflicts, including sexual violence. Prosecuting this crime relies primarily on survivor accounts, but witnesses often fear the psychological effects of giving such testimony, particularly because there is a high risk of retraumatization, a stigma associated with victimhood, and a fear of victim-blaming. Thus, the Court’s Victims and Witness Unit (VWU) puts forth provisions for questioning vulnerable witnesses, requiring, in part, (...) that questioners avoid embarrassing or offending witnesses. Using a discourse analytic approach, this paper examines transcripts from three recent ICC cases dealing with wartime sexual violence—_Bemba, Ongwen_, and _Katanga and Chui—_exploring the discursive strategies employed by prosecutors and defense attorneys in these trials as they navigate arguing their cases before the judges while also tailoring their questions to adhere to the VWU’s provisions. I show that adhering to the provisions often involves relying on euphemistic expressions to discuss rape—which enter the trial discourse through linguistic formulations and reformulations—even though these expressions reflect the language used to discuss consensual sex and not sexual violence. Thus, this method of adhering to the provisions can undermine the prosecution’s case while helping the defense’s. (shrink)

For the last 50 years the dominant stance in experimental biology has been reductionism in general, and genetic reductionism in particular. Philosophers were the first to realize that the belief that the Mendelian genes were reduced to DNA molecules was questionable. Soon, experimental data confirmed these misgivings. The optimism of molecular biologists, fueled by early success in tackling relatively simple problems has now been tempered by the difficulties encountered when applying the same simple ideas to complex problems. We analyze three (...) examples taken from experimental data that illustrate the shortcomings of this sort of reductionism. In the first, alterations in the expression of a large number of genes coexist with normal phenotypes at supra-cellular levels of organization; in the second, the supposed intrinsic specificity of hormonal signals is negated; in the third, the notion that cancer is a cellular problem caused by mutated genes is challenged by data gathered both from the reductionist viewpoint and the alternative view proposing that carcinogenesis is development gone awry. As an alternative to reductionism, we propose that the organicist view is a good starting point from which to explore these phenomena. However, new theoretical concepts are needed to grapple with the apparent circular causality of complex biological phenomena. (shrink)

University program dropout is a problem that has important consequences not only for the student that leaves but also for the institution in which the withdrawal occurs. Therefore, higher education institutions must study the problem in greater depth to establish appropriate prevention measures in the future. However, most research papers currently focus primarily on the characteristics of students who leave university, rather than on those who choose to pursue alternative courses of study and therefore fail to take into account the (...) different kinds of abandonment. The aim of this paper is to identify the different types of dropout to define their characteristics and propose some recommendations. Thus, an ex post facto study was carried out on a sample of 1,311 freshmen from a university in the north of Spain using data gathered using an ad-hoc designed questionnaire, applied by telephone or an online survey, and completed with data available in the university data warehouse. A descriptive analysis was performed to characterize the sample and identify five different groups, including 1. Students persisting in their initiated degree 2. Students who change of program (within the same university) 3. Students transferring to a different university 4. Students enrolling in non-higher-education studies 5. Students that quit studying. Also, data mining techniques (decision trees) were applied to classify the cases and generate predictive models to aid in the design of differentiated intervention strategies for each of the corresponding groups. Roman Catholic healthcare institutions in the United States face a number of threats to the integrity of their missions, including the increasing religious and moral pluralism of society and the financial crisis many organizations face. These organizations in the United States often have fought fervently to avoid being obligated to provide interventions they deem intrinsically immoral, such as abortion. Such institutions no doubt have made numerous accommodations and changes in how they operate in response to the growing pluralism of our (...) society, but they have resisted crossing certain lines and providing particular interventions deemed objectively wrong. Catholic hospitals in Belgium have responded differently to pluralism. In response to a growing diversity of moral views and to the Belgian Act of Euthanasia of 2002, Catholic hospitals in Belgium now engage in euthanasia. This essay examines a defense that has been offered of this practice of euthanasia in Catholic hospitals and argues that it is misguided. (shrink)

Reunião de ensaios em comemoração aos 90 anos de vida de Ana Maria Araújo Freire, viúva de Paulo Freire. Ana Maria Araújo Freire é reconhecida por seus esforços e seu êxito na divulgação do pensamento do Patrono da Educação Brasileira. Nita, como é carinhosamente conhecida, tem também uma prestiogosa trajetória: é mestre e doutora em Educação pela Pontifícia Universidade Católica de São Paulo, época em que foi orientada por Paulo Freire. Em 1986, ambos já viúvos, os então amigos recifenses se (...) reencontraram depois de anos de afastamento. Da troca de ideias e ideais acerca de uma educação libertadora, surgiram a paixão e o amor. Nita e Paulo Freire foram casados por dez anos, período em que ela acompanhou a escrita de Pedagogia da autonomia – um dos títulos mais lidos do educador – e no qual apoiou seu marido na produção de outros três importantes livros: Pedagogia da esperança, Cartas a Cristina e À sombra desta mangueira. Por comungar da intimidade intelectual e pessoal de Paulo Freire por tantos anos, o caminho natural, após seu falecimento, foi desdobrar sua dedicação de esposa numa missão que tomou para si com muito orgulho: a difusão do pensamento freireano. A autora possui vasta produção intelectual nesse sentido, tendo sido finalista do prestigioso Prêmio Jabuti, em 2007, com a biografia Paulo Freire: uma história de vida. Este livro apresenta-se como o resultado da contribuição de professores e pesquisadores de diversos campos da filosofia e de diferentes universidades brasileiras durante a ocasião do I Encontro "Vozes femininas na Filosofia", ocorrido em junho de 2017, na UFRGS, em Porto Alegre, RS. Nossa motivação parte da constatação que a área de filosofia nas universidades brasileiras sofre uma evidente crise de representatividade: tanto nos cursos de graduação como nos programas de pós-graduação em filosofia, nos quais menos de 30% são mulheres, (...) entre docentes e discentes. Procura-se, por meio dos textos organizados neste volume, entender a produção e a contribuição de filósofas cujas presenças se mostram diminuídas – senão totalmente esquecidas – na história de filosofia e na atualidade. Following the 15th anniversary of the European Society for the History of Science (ESHS), one can definitely say that this relatively young society has come of age. Through regular meetings, a journal, a prize, fellowships and various other activities, the ESHS has been striving to create a space fostering diversity, plurality and internationalization among historians of science, located in Europe and elsewhere. This paper revisits my own research on the past of the sciences in Portugal, examining in particular the role (...) of the 18th century naturalist and diplomat Abbé Correia da Serra. As a member of an extended network of estrangeirados (Europeanized intellectuals), Correia da Serra played a decisive role in the circulation of knowledge in Europe and also in the world, a role forgotten by his peers within the time interval of a generation. This case study acts as a springboard to discuss the importance of geographical and methodological diversity in the past of the sciences in Europe. In the present historiographical predicament in which the international community finds itself, I advocate that one of the main challenges faced by the ESHS is to turn its historical gaze to Europe again, while fiercely repudiating Eurocentrism. This enables to show how much the building of the European spaces of scientific practice were never a prerogative of a few regions or a small set of countries, but, on the very contrary, took shape as the result of complex interactions between diverse spaces and cultures, not only intra-European but also non-European. The problem sketched here in a non-conformist phenomenological manner concerns the transition from the theory of the self-sufficient individual to the theories of the social character of human being, and to the theoretical possibility to control the social asymmetries opposing to its fulfilment.

Tekst analizira nacin na koji nastavno osoblje na Beogradskom univerzitetu percipira bolonjski proces, nacelno i unutar lokalnog srpskog socijalnog i univerzitetskog konteksta; razlicite upravne instance unutar univerzitetskog obrazovnog sistema, mesto nastavnika unutar obrisa novog visokoskolskog obrazovnog sistema u procesu bolonjske transformacije. Empirijsku osnovu predstavlja istrazivanje o uslovima rada nastavnog osoblja koje je Centar za obrazovne politike iz Beograda izveo na pet fakulteta Beogradskog univerziteta tokom 2008 godine.

This article aims to explore a sapiential response to the question of the inner experience of the conflict between the voluntary and the involuntary, which Ricœur alludes to in the first volume of his _Philosophy of the Will_. I take as my starting point Ricœur’s reference in the conclusion to the three pieces of advice given by Descartes to achieve contentment, which Ricœur equates with the virtues of decision, effort and consent. Building on Ricœur’s assertion that we receive the life (...) of the involuntary into the heart of freedom through attention, I seek to explore how attention can help reconcile the conflicting relationship between the voluntary and the involuntary in everyday experience. I do so by proposing a rereading of these three virtues in the light of the practical mediation of attention. (shrink)

Trafficking in human body parts is one of the most severe form of crime in modern times. The topicality of this phenomenon reinforces the fact that it is intertwined with organised crime and human despair. The resulting repercussions are dangerous for the “donor”, prosperous for the “intermediaries”, and vital for the “recipient”. The paper analyses the phenomenon of trafficking in human body parts, which is directly related to the development of transplant medicine and surgery. Human organ transplantation is moving toward (...) indicative ethics, as ethics of responsibility, and is gradually moving beyond imperative ethics, emphasising duty. Human organ donation is an act of self-sacrifice. Therefore, from an ethical and moral perspective, the commercialization or trafficking of human organs is unacceptable because it violates human dignity. In addition to the ethical implications, the paper analyses international documents on this topic and the Croatian normative regulations on this issue. Finally, bioethical and criminal law answers to this question are given. (shrink)

This article examines the conditions of internet access and uses by children and young people from socially disadvantaged environments in Portugal. Adapting the EU Kids Online questionnaire, a sample of 279 participants in an intervention program on digital inclusion was interviewed in order to analyze their online experiences, bearing in mind the EU Kids Online results and the wider debate on digital inclusion. This issue was examined at two levels: access, and practices and uses. Although economic deprivation, parents’ low educational (...) attainment and children’s age and gender seem to matter in terms of access, reported uses were analogous to the average Portuguese and EU Kids Online data. However, with these children apparently being more oriented towards entertainment and having less informational skills, it is questionable if policies that merely assure access are entirely sufficient. Nevertheless, one cannot say straightforwardly that ‘social exclusion’ equates ‘digital exclusion’. (shrink)

Surrogacy is an increasingly frequent form of family building and allows individuals to become parents despite an infertility diagnosis or a biological impossibility. Positive outcomes for both the surrogacy child and the surrogate mother have been reported, including in cases of same-sex male couples and single persons. There is an on-going debate because remuneration does not necessarily involve undue inducement of the surrogate or transformation of the child into a commodity. The right to regret and the doctors’ autonomy are also (...) addressed in this paper. Nevertheless, literature on surrogacy is scarce, and most of the existing studies have important methodological limitations, so further investigation is much needed. We believe that counselling should be granted for both intended parents and surrogate, in order to prevent the majority of problems. We also agree that parental vetting should be possible, focusing the doctor’s responsibility also in the future child. (shrink)

Arthur Schopenhauer’s Mirror: the Will, the Suffering, the Compassion as Philosophical Challenges. In philosophy, the celebration of Arthur Schopenhauer has already ended. Only the last year was anniversary (of his birth and of the publication of the first volume of The World as Will and Representation), but the importance of this non-conformist creator is never superfluous to highlight. In this article, there is, certainly, a very limited/selective focus on the thinking of Schopenhauer, and no biographical approach: the goal is only (...) to stress two aspects of his philosophy in their logic. Schopenhauer was an enthusiastic Kantian: first of all, by taking over his maestro’s seminal paradigm, the constructivism (that does not pertain only to the theory of knowledge, but marks the entire existence analysed at different philosophical levels). Secondly, by the ethical focus and accent, continuing Kant’s exceptional emphasis of the ultimate reason of the tableau of the world, the human reason and its power to treat the others in a moral manner. And certainly, Schopenhauer was not an epigone, but a creator, using and at the same time giving other content to the Kantian form of ethical revolution. Schopenhauer had, obviously, contradictory ideas – as that between his constructivism and his metaphysical treatment of the will, i. e. as the only principle explaining the world – and also with disputable significance, including for the actual life and thinking. But he had a bad publicity from the dominant philosophy – namely, some of his ideas (as that of the moral of compassion) were, and still are, absolutely ignored, while other ones were simplified or transformed in the conception of Schopenhauer, reducing this one to some ideas out of context – and even nowadays this tradition is dominant. And it’s pity, because Schopenhauer’s philosophy was and represented a dramatic moment in the history of the 19th century thinking and culture: as it is a strange mirror for the present much graver situation. In order to critique the present it’s not necessary to do it from Schopenhauer’s perspective. However, just his contradictory ideas and pathetic accent on compassion show better than ever that neither philosophy – as theoretical position – nor the urging for moral activism are more than vox clamantis in deserto: if the historical facts, which include this urging and the spring of thinking but are not confined to them, are missing. In the Nicomachean Ethics, Aristotle has given a tableau of the desirable virtues and their infringement through the surpassing of their limits. Thus, every virtue is framed or delimited by vices that represent either its excess or its deficiency. However, this type of defining is related to deep, metaphysical reasons: since every being, especially the living one, has its telos. Man’s telos is to practise and fulfil his human specificity, i.e. reason, and reason is the measure/quality of virtue as such; (...) the excess or deficiency in his behaviour perverts and even stops the realisation of the humanity of man. And this humanity is, in turn, in accordance to the telos of nature, the good in and for the preservation of all things. If, hypothetically, persons would not be virtuous at all, this accordance would not be realised and man would be an accident in the logic of nature: and accidents are removed, sooner or later. The criterion of the “quantitative” moral evaluation is thus qualitative: a quality, the good aimed at by mindfulness applied to the concrete particular moral relations and learned from experience. This paper is written in the continental tradition – facing the analytic one – and advocates the knowledge first thesis, reviewing the entailment thesis (where believing is knowing, because to know entails to believe). It starts from the ancient distinction between knowledge and opinion and develops criteria for distinguishing knowledge, opinion and belief. The demonstration necessarily arrives to the kinds of beliefs and thus, to the relationships between knowledge and these kinds. While the distinction of kinds of beliefs leads to (...) the understanding of why the knowledge belief problem did appear in epistemology, the analysis with this distinction is not rigid and can be approached dialectically. Although the concept of human nature may seem problematic, its a-historical essentialism can be used to show the fall of modern European philosophy into the historical pit of unsolvable contradictions. This paper explores the problems of logical contradictions between the modern and universalistic concept of human nature and the discriminative model of inferior-superior humans, mainly illustrated by racism. First, this paper shows that the concept of human nature is valid beyond the arguments related to evolution and social contexts, although the (...) human nature is modelled by them, and that the concept is not opposed to the specific cultural peculiarities of different human communities. Furthermore, common elements of racism both at the moment of its creation and nowadays suggest a radical possibility for resolving the antagonisms between the thesis of universality in the human being and the thesis of the particularity of unique cultures. IntroductionHistory of depression symptoms, including before and during pregnancy, has been identified as an important risk factor for postpartum depression symptoms. This condition has also been associated with diverse implications, namely, on the quality of mother–infant bonding. Moreover, the role of self-criticism on PPD has been recently found in several studies. However, the link between these factors has not been explored yet. Furthermore, anxiety symptoms in postpartum has been less studied.MethodsThis study analyzed whether the history of depression symptoms predicted mother–infant (...) bonding, via self-criticism and PPD symptoms. The same model was repeated with a history of anxiety and postpartum anxiety symptoms. A total of 550 mothers of infants <24 months old participated in this cross-sectional study and answered an online survey.ResultsThrough a parallel–serial mediation model, the results show that in a first step, self-criticism dimensions of inadequate-self, hated-self, and reassuring-self, and in a second step, PPD symptoms, mediate the relationship between the history of depression symptoms and mother–infant bonding. However, the relationship between the history of anxiety symptoms and bonding is not mediated by all the considered chain of mediators, being only mediated by one of the self-criticism dimensions, inadequate self.ConclusionsThe current study confirmed the association of history of both depression and anxiety with mother–infant bonding. While in the case of history of anxiety symptoms, the relation was only mediated by inadequate self-dimension of self-criticism, in the case of history of depression symptoms, the relation was mediated by self-criticism and postpartum depressive symptoms. The buffering effect of reassuring-self on bonding and negative affect was also evidenced. Psychological and preventive interventions should address this evidence to target interventions for mother–infant bonding problems in accordance with previous and actual current maternal risk factors. The World Bank estimates that over one billion people currently lack official identity documents. To tackle this crucial issue, the United Nations included the aim to provide legal identity for all by 2030 among the Sustainable Development Goals. Technology can be a powerful tool to reach this target. In the digital age, new technologies increasingly mediate identity verification and identification of individuals. Currently, State-led and public–private initiatives use technology to provide official identification, to control and secure external borders, and to (...) distribute humanitarian aid to populations in need. All of these initiatives have profound implications for the protection of human rights of those affected by them. Digital identity technologies may render individuals without legal documentation more visible and therefore less vulnerable to abuse and exploitation. However, they also present risks for the protection of individuals' human rights. As they build on personal data for identification and identity verification, data protection and privacy rights are most clearly affected. The prohibition of discrimination in the digital space is also of concern as these technological advances' societal impact is not yet fully understood. Accordingly, the article argues that emerging digital identity platforms will only contribute to the protection of human rights if the providers adequately mitigate any risks of potential discrimination and promote high standards of privacy and data protection. The technological solutions adopted during the current pandemic will have a lasting impact on our societies. Currently, COVID-19 health status certificates are being deployed around the world, including in Europe, the United States and China. When combined with identity verification, these digital and paper-based certificates allow individuals to prove their health status by showing recent COVID-19 tests results, full vaccination records or evidence of recovery from COVID-19. Most countries in the Global South, where vaccination rates are low, have not yet (...) fully implemented such certificates, although several initiatives are currently underway. That is, for instance, the case in the African Union. Yet, it is not sufficient to develop technical solutions for the verification of COVID-19 health status. Because technologies do not evolve in a legal vacuum, the existing laws and regulations must be respected. The risks of implementing such technologies must be anticipated and mitigated as much as possible before any large-scale deployment. Risk mitigation should also underpin strategies throughout the deployment of these certificates. This article evaluates the key legal implications of COVID-19 health status certificates for data privacy and human rights. In doing so, it contributes to the current debates, thus informing policymakers in this area of vital national and international interest. (shrink)

THEOLOGICAL REFLECTIONS ON IMMIGRATION HAVE LARGELY FOCUSED ON mandates to love the stranger and protect human rights. The U.S. and Mexican bishops' pastoral letter "Strangers No Longer" is no different. However, this ethical focus leaves Christians without sufficient theological guidance when seeking to balance concern for immigrants and U.S. citizens alike. This essay examines undocumented immigration to the United States through the lens of the common good, using a contemporary Catholic feminist understanding of the common good. It examines the impact (...) of immigration on this country and makes policy recommendations that are consistent with the common good. Many of the recommendations are consonant with the bishops' recommendations, but one important recommendation missed by the bishops is that efforts to promote a liberal immigration policy must be accompanied by efforts to promote just wages and working conditions for all low-wage U.S. workers. The literature studying the characteristics associated with revictimization in Intimate Partner Violence is heterogeneous and inconclusive. The absence of studies on the role of the emotional variables of the victims and the failure to distinguish revictimization by the same or different aggressors are two of the main limitations in this area of research. The aim of this work was to study the relative contribution of the material, social, and emotional resources available to IPV victims in predicting revictimization by the same (...) or different perpetrators. The sample consisted of 290 women registered in the city of Madrid who had filed at least one police report for intimate partner violence. The material resources of the victims were evaluated through their level of monthly income and employability status, the social resources through perceived social support, and the emotional resources through emotional regulation and coping strategies. Hierarchical multinomial logistic regression models were estimated to predict single-offender victimization, same-offender revictimization, and multiple-offender revictimization. The results revealed that: differentiating between revictimization by the same and different aggressors improved the fit of the model by 50.8% compared to when only differentiating between victimized and revictimized women; material resources had no significant weight in the prediction of any type of revictimization; SRV women had more social support than VSRDA women ;, those victims who had made several reports to the authorities of violence by different aggressors, had worse emotional regulation than those victims who had made a single report to the authorities ; and VSRDA obtained the worst mental health indexes and they used more coping strategies based on positive reappraisal than the VSR women and those victims with several reports by the same aggressor. These results show that being a victim of several episodes of intimate partner violence by different aggressors should be understood as a form of revictimization of great severity associated with worse emotional regulation and less social support. Glavni cilj realizacije ove teme jeste konstruisanje adekvatnog analitickog instrumenta za promisljanje i istrazivanje reforme sistema visokog obrazovanja. Prvi je pristup Lika Boltanskog i Ev Sijapelo koji proucavaju razvoj 'novog duha kapitalizma' tako sto se usredsredjuju na odnos dva makroaktera - kapitalizma i kritike; drugi je pristup Najdzela Trifta koji uspon 'mekog kapitalizma' dovodi u vezu sa jacanjem 'kulturnog kola kapitala'; i, na kraju, imamo pristup Ricarda (...) U prvom delu ovog teksta autorka se bavi teorijskim i metodoloskim posledicama upotrebe pojma polja Pierrea Bourdieua u istrazivanju oblasti knjizevne proizvodnje. Ove posledice su ispitane kroz opozicije karakteristicne za tradicionalnu sociologiju umetnosti i knjizevnosti, izmedju sociologije i hermeneutike, internalisticke i eksternalisticke analize konteksta i teksta, sadrzaja i forme, socijalnog i estetskog. Drugi deo je posvecen analizi glavnih ideja Bourdieuove sociologije kulturne proizvodnje. Teorija knjizevnog polja koju predlaze Bourdieu, dopusta da se razume specificnost svojstava i zakona polja knjizevne proizvodnje. Ispituje (...) se u kojoj meri je ovaj sociolog modifikovao svoj metod analize da bi realno konstruisao polje proizvodjaca kulturnih dela, polje dela, kao i sistem odnosa koji se uspostavljaju izmedju ova dva skupa odnosa. Comparing and contrasting nonreligious and religious perspectives on ethics and morals has perhaps attracted the greatest attention of any secular study area. There are indeed negative preconceptions about seculars that express worries about how morality can be preserved without the influence of religion. The research begins with definitions and categories of morality, along with current views on how they came to be and how to evaluate them. Examined are secular attitudes and actions in areas including prosociality, violence, criminal activity, drug (...) usage, sexual orientation, helping, and altruism. Secular morality is showing a trend in many sectors towards prioritizing individuals above group affiliation. General morality among secular people favors moral consequentialism over deontology and reasoning over intuition. Religious ethics explain that society can only be improved if human beings have a pure soul. So, we can say that religious Ethics have a main focus on the improvement of spirituality and the soul of human beings for a peaceful society. So, this is also a point of divergence between secular Morality and Religious Ethics. (shrink)
